Criminal trials can be overturned for those things as well but it takes quite a trick to do it unless it is DNA, etc. and then it is difficult many times because the DA's and the judges fight it.
The Jeffrey McDonald case is one. I read a book a few years ago about an independent study of the evidence and found that the numbers of errors,lies, and mispresentations in that case were enorous--up to and including completely false evidence testimony by an FBI agent (testified to the exact opposite of what the tests/info contained). And these weren't little picky errors, lies and misrepresentations--some were huge in scope.
In that case what the FBI agent did was take a long artificial strand of blond hair to the Matelle doll company and check it out. They told him it was NOT doll hair, could NOT be doll hair as no doll company in the world had doll hair that long (their machines didn't make them that long) and that it WAS artificial hair from a wig.
What he TESTIFIED was that the Matelle company had told him it WAS doll hair, could NOT be wig hair and that it Matched a doll in the house belonging to one of the victim children.
Thus completely destroying the fact that a crazed drugged out blond woman was in the house that night.
The book was filled with other such instances--some as blatant and others that weren't but they got NOWHERE in asking for a new trial.
And though we are seeing a lot of cases recently overturned where they find the real killers due to other cases or confessions, etc. that was not the case with McDonald. Several people confessed both verbally and in writing over the years---the very people suspected in the first place--and the confessions, etc. have been totally ignored by the cops and the DA's and the courts.
What the McDonald and OJS case may have in common is that it was strongly believed by many---including the judge in the court martial where McDonald was acquitted of the crimes---that the investigating cops were involved (at least one) and/or they were covering up for who did it.
Example of why the judge and others thought that. McDonald called for help with a bloody hand on the bedroom phone. Someone else used the kitchen phone to call an ambulance. YET, when the print people did their job, both phones had been wiped clean of prints and it was the kitchen phone where McDonald said the woman answered the phone and should have had prints on it. THe ONLY people there in the house from the time they found the family dead and McDonald badly wounded were the cops. HE didn't wipe the phone prints off (his bloody ones included) since the phone had to be pried from his hand. When tested, that phone didn't even have blood on it.
There are more reason that the judge thought the head cop was involved or covering up for the real killers (a drug connected case) but this with the phones is so like what happened in the Bundy case with phones, etc.
As I said, the common factor in the two cases is the possible involvement of the investigating cops, therefore, the appeals and exposure of gross lies and perjury and confessions has gone nowhere.
