I hope this works but have serious doubts. One day there may be a different prosecutor who might let it happen, esp. if he wins against the present one. But prosecutors are so afraid to be caught in their malfesense that they will do anything to stop a new trial. And that goes for the judge also. They have to prove that their is not evidence that COULD NOT be optained during the trial or that something the judge did was unconstitutional or inadequate defense and I don't think that have meet any of those high hurdels yet.
