Prien, ……... Let me be specific about the separate 10:17 – 10:28 phone bill that Shapiro brought up in the preliminary hearing. He asked Marcia if that bill, which she gave to the defense, was accurate. He asked for her copy. She said that she couldn’t get her hands on it at the moment but if that’s what he had that was what she had. That’s when he made the stipulation accepting that phone bill as accurate. ………Marcia was arguing a 10:15 to 10:20 start of the killings. The defense wanted the prosecution to stick to this timeline using Fenjves and Stein as their best witnesses (the prosecutors didn’t contact Storfer until four or five months later). The defense had more timeline witnesses and far better ones, all of whom set the start time for the killings after 10:24. Since the prosecution bracketed the time so narrowly, the defense could have even used Storfer as a witness for O.J. He said that he looked at a digital clock around the time the dog started barking and it said 10:28 but it was set five minutes ahead making the actual time 10:23. But if he misread the “2” and it was actually a “3,” which can happen when glancing at some LED displays, his time and Pilnak’s time are identical – 10:33. ……….If the prosecution rests its case on the 10:15 to 10:20 start time the 10:17 to 10:28 phone record is O.J.’s ironclad alibi. All of the prosecution evidence rested on this timeline. Ergo, the evidence must have been planted and someone must have shifted the apparent time of the murders in the false belief that O.J. did not have an alibi for that time. This argument works for anytime Nicole and Ron were actually killed after 10:28. But if the records were consistent with the bills and Marcia knew it (as you pointed out, she had to have the actual records within a day after the murders) her best bet was to get the defense to question their validity and go after a later phone bill that didn’t exist. ……..In that event, the games Marcia played with both phone bills were designed to work like a booby-trap – something very tempting to the enemy that explodes in their hands when they pick it up. I think that’s what she tried to do and why Brad Roberts wrote down 11:15 as the time Schwab first said he found the dog. Schwab said he was all over the place, sometimes saying 11:00 and sometimes saying 11:30 but never 11:15. ……..Roberts knew how the LADA operated as a matter of course to win convictions at a phenomenal rate of 95%. Not surprisingly, as WE now know how the prosecutor’s office worked, Schwab’s corrected time was buried until Marcia saw how she could use it to her advantage. ……..When all is said and done, it was Fuhrman’s partner Brad Roberts as much as Juditha Brown who set up the trail leading to an 11:00 phone conversation between Juditha and Nicole on the FIRST DAY of the investigation. If this was a false trail the killer wanted the defense to follow everything that Marcia did to obscure the 10:17 – 10:28 phone record she must have had the first or second day, falls into place, provided the killer knew she would do it. Whether it worked or not, Fuhrman had a false alibi ready to go. –Jasper
