I believe you are making reference to one of the revelations in Joe's book--the fact that the Grand Jury was not going to indict OJ Simpson--they were dead-locked 11 to 11. And so there wouldn't have been a trial. But I don't agree on this one. It was only a question of time until Simpson would have been indicted. They can call a Grand Jury whenever they want to, and certainly would have after the DNA came in. Therefore, Shapiro (who I'm sure realized this) asked for a pre-lim in order to see a good chunk of the Prosecution's case as early as possible. Now of course there are pro's and con's to that. You also run the risk of the public siding with the Prosecution and not being able to have a chance to answer the Prosecution's charges until well into the trial. That in fact did happen in this case. But the pro's far outweghed the con's in my opinion--at least in so far as how the defence was able to build it's case in the criminal trial.
I agree with your point that Simpson would have been out of here if he had been guilty.
