I can’t add much substance to what Charlie and John pointed out. I can only add a few more details and my own perspective on the proceedings. Here goes….

Hiroshi Fujisaki, the judge in the civil case, allowed into evidence anything that purported to show O.J.’s guilt. That included unauthenticated stories that Nicole supposedly wrote down or told someone about (without respect to the fact that Ron Shipp was an expert in forgery). It included a photo of Nicole’s “battered” face that O.J. said was makeup for a movie made in 1979. Denise said she took it in 1989 after O.J. beat her up. Judge Ito would not allow it into evidence in the criminal trial because he noticed that the photo paper was dated 1979 and had a self-life of one year. Fujisaki also allowed into evidence a reported phone call from Nicole to a woman’s shelter with not evidence to show who really made the call.

Actually, the State of California had to change the hearsay law, to allow the use of hearsay evidence that Fujisaki okayed. So you have to hand some of the “credit” for that to the California State legislature.

Meanwhile, the defense was expressly prohibited from arguing that O.J. Simpson was framed. Fujisaki made that ruling because he found no credible evidence for a scenario in which Mark Fuhrman found the second glove on Bundy and moved it to Rockingham. No other frame-up scenarios could be considered.

The judge did not allow the defense to question Faye Resnick on any subject related to her drug use, ergo no questions about when, where and how she might have met Mark Fuhrman or Denise Brown before the murders or any other scenario for killings involving her and drugs.

The last minute addition of the photos showing O.J. in the Bruno Magli Lorenzos convinced most the jurors, and the media, that O.J. was a proven liar. The photos were faked, but the defense didn’t have the right expert on the stand to show how it was done when they were presented and the judge did not allow them time to prepare an effective rebuttal. Some people wanted to see O.J. tried for perjury because he said that he didn’t kill Nicole, didn’t beat Nicole, and because he didn’t tell the truth about his alibi or his ownership of the Bruno Magli Lorenzos. This is one time where it would have served O.J. well to be put on trial because a rigorous examination of these specific charges would have been required, which would have proven his innocence beyond any reasonable doubt. The only problem with that evidence is getting people to look at it. I’m convinced that that is the principle reason those charges were never pursued. -- Jasper
