The rules on the books were broken but not the ones in common practice. Going back to the Talking Heads on Court TV while the criminal trial verdict was coming in the repeating message was the O.J.’s defense team was able to do things that most criminal defense teams could not do. They could afford private investigators and expert witnesses that most defendants couldn’t get. They were able to delay O.J.’s arrest and they did not seek the death penalty.
On the evidence the prosecution had and the way they got it (bad search warrant, broken chains of custody, etc.) the case never should have gone to a grand jury much lest past one. If O.J. had been any other suspect he would have gone straight to jail on day one and stayed there until they sent him to death row. That’s how things usually got done in the California Justice System. --Jasper
