I gave a LOT of thought to whether O.J. or Kato was lying.

Kato and O.J. could have best protected themselves by saying that they did see each other. O.J.’s story leaves doubt about where he was coming from. Kato’s story gives O.J. an airtight alibi but you have to work your buns off to see it. It also makes Kato look suspicious. Neither of them showed that they understood the significance of what they said. The prosecution NEVER saw it. The defense NEVER saw it. Dan Petrocelli did…

Kato did see O.J. after he came from the south path. He saw him the second time. Petrocelli made it clear from the start that he was going after O.J. AND Kato, approaching Kato as a hostile witness. He accepted the short timeline of the defense in the criminal trial but for the shortened timeline he needed a clean-up man for O.J. at Rockingham. He picked Kato. In his book after the trial, he admitted it.

I do not consider 23 seconds to be an accurate representation of "simultaneously" or "a few seconds", either. We have the same problem, though, with a third of that interval. The best you can do, without assuming that O.J. and Kato lied, is about 8 seconds. You’d have to cut that in half to get near “simultaneously.”

I don’t think anybody lied. I think that Park saw Kato while his mind was on something else until he disappeared in the shadows and THEN he saw O.J. When he was asked to recall when he first saw O.J. his closet memory of seeing Kato relative to O.J. was almost simultaneous. He didn’t recall seeing Kato anywhere except the place where he first saw him (the north path) until the lights came on in the house and Kato opened the gate about 30 seconds later.
