The operative word here is “exact.” A fraction of one degree is nowhere near exact in terms of the variables involved. A fraction of one degree could encompass all of them. There is simply no way to tell if there SHOULD have been a difference – but you can debate it forever. If you want to sew confusion, creating an irresolvable debate is hard do beat.

I agree with your bottom line. Only I would say it another way….

I see it as a non-issue that was deliberately made an issue of fruitless debate. The difference is it gave the prosecution a timeline that it could argue and it allowed it to argue that ALL of the defense’s scientific challenges were “smoke and mirrors.” It was a trap and the defense fell for it. On the coroner’s time of death non-issue the defense did use smoke and mirrors to make it appear to be an issue. The real issue is why and how Phillips and Fuhrman suckered them into doing it. –Jasper
