What I think is that Rachel was at the Mezzaluna but not sitting with the Browns. And that she may have gone to the ice cream store with a Mom or Dad but not actually with Nicole. Perhaps in the store at the same time.
Either that or the Mezz employees left her out on purpose. At the direction of the DA's.
It is one of the strangest things about this case for the pure fact it doesn't seem to make any difference in the long run whether she was there at the Mezz and ice cream store or not. Doesn't SEEM to is the operative word.
By leaving her out of the Mezz and ice cream store scenario--they got by with leaving out that she was at the Bundy condo for a while til her Dad picked her up and when--effectively leaving him (or the mother) out of having to testify.
I noticed in the hearing after the opening statements that the DA's had Rachel Berman on their list as did the defense. It was said that originally they had the mother only but the defense decided to get a statement from 8 year old Rachel.
I have always thought it purely strange that Judy said like a mantra that they went to the Mezz with family and FRIENDS. She said this repeatedly and almost stressed it. Yet when the testimony is given-only the Browns are given as having been there.
I recall that Judy would be asked about it in interviews and the reporter would say "with your family" and Judy would insert "and friends" like clockwork.
I believe that the whole restuarant was probably filled with people who had attended the recital. Other parents and children, etc.
I think we might be surprised as to who was at the MEzz as well that night who were never mentioned.
