Jasper, I realize some of the things I mentioned in the post just before this one we have known all along. The reason I mention them is that that SCREAM out at a viewer when you watch it---and may very well have been part of the 'common sense" that the jurors used.
For example----Phillips actually Lying to the coroner's office about not knowing the ID of the victim's (at least Nicole) when they have "known" for hours. Not just putting him off because it is media sensitive info but actually lying.
Pair that with the deliberate delay of calling the coroner for 10 hours to hide the actual time of death is a powerful statement to the jury.
About the missing piece of paper--Fung saw the photo and actually looked stunned and puzzled that the piece of paper was in the photo---as if it was not there when he arrived---hence --missing.
