This was on April 3. Det. Luper and Det. James Harper of RHD testified before Marcia did. Marcia was not put under oath. It was Harper, not Luper, who changed his story about seeing Maria with Fuhrman on the 13th under the guidance of Sherry Lewis. She suggested that he might have seen them together on the 28th rather than the 13th. Harper was then no longer sure that the event he recalled (Marcia conferring with Fuhrman at a table in O.J.’s backyard) happened on the 13th or the 28th . A videotape showing the dress that Marcia was wearing on the 13th confirmed that he was correct in the fist instance. He didn’t lie. He just got confused about the date.
Luper said that he recalled five detectives during the first search on the 13th, himself, his partner Cliff LeFall, James Harper and his partner Richard Haro, all from Robbery/Homicide, and Detective Roberts of West LA. He got Roberts name wrong at first and called him “Rogers.”
Harper remembered seven detectives. He remembered Fuhrman and Phillips.
It is very interesting to me that Marcia says in her book that Fuhrman gave her “the Grand Tour.” This is what she said in her unsworn testimony on April 3, 1995:
“DETECTIVE LUPER WALKED ME AROUND A LITTLE BIT, I THINK ROBERTS DID, I THINK DETECTIVE FUHRMAN DID. ON THE 13TH I NEVER SAT OUTSIDE AT A TABLE WITH ANYBODY. I WAS THERE BRIEFLY. I MADE REQUESTS OF THEM CONCERNING WHAT TO PHOTOGRAPH AND IN WHAT SEQUENCE, AND THESE ARE STILL PHOTOGRAPHS, IN WHAT SEQUENCE TO PHOTOGRAPH SO THAT IT WOULD BE UNDERSTANDABLE AND CLEAR. AND I ASKED THEM TO MAKE SURE THAT THEY PICKED UP CERTAIN ITEMS IN THE SEARCH AND HE INDICATED TO ME, DETECTIVE LUPER, THAT THERE WAS NO SEARCH TEAM AVAILABLE AT THE TIME, THEY WERE IN A HOLDING PATTERN FOR AWHILE. I HAD OTHER WORK TO DO SO I DIDN'T WAIT FOR THE SEARCH TEAM, AND I LEFT ROCKINGHAM AT ABOUT FIVE MINUTES TO 2:00.”
According to this testimony from Marcia as well as Luper’s testimony, Luper gave her “the Grand Tour.” According to what you gave us from Marcia’s book, it was Fuhrman. The tape shot from the TV news helicopter showed that the sequence of events that Fuhrman recounted in his book, part of which was observed by Det. Harper, was correct.
The bottom line is, Luper did lie for Marcia but I don’t know how we can prove that she got him to do it. –Jasper
