Phil Baker’s question to Denise about the January DWI arrest is a big part of it as will as Kelly’s instruction to Denise not to answer. There was no harm in simply saying “no” unless her lawyer feared that Phil and Bob Baker had a copy of the police report that would impeach her testimony. It might still be available to the public through the Freedom of Information Act.

Had Denise been called to testify in the civil trial I’m sure that you would have seen the arrest report, which would have answered all of your questions about Denise’s DWI convictions, including the critical dates. I’ve been trying to find them myself. All I came up with was the same information you got from the same source (Jeffery Toobin’s The Run of His Life).

Denise made so many inconsistent statements in the criminal trial and in her deposition that the plaintiffs’ attorneys would have been crazy to put her on the witness stand during the civil trial….

Item 1: Denise claimed that she never met Faye before the murders. At one point in her deposition she claimed that Nicole never mentioned Faye’s name but she backtracked and admitted that Nicole might have mentioned her name. That’s where the dates become important. Faye was a frequent visitor at Nicole’s Bundy Condo in 1994 and Denise stayed there over night at least a dozen times that she admitted, to be close to her job in Torrance. She couldn’t recall the address but it had to have been less than ten minutes away from Fuhrman’s home in Redondo Beach. Why take a low-paying sales job an hour away from home? And why deny that she knew Faye? They must have at lest met in passing a time or two.

Item 2: Denise clamed that she took the Polaroid photo of Nicole’s “battered” face in 1989 that Judge Ito saw by the date on the back could not have been taken after 1979. O.J. said that in that photo she was wearing makeup for a movie he made in 1979 (Detour to Terror). Rolf Baur, Denise’s cousin who lived with the Browns in Germany since he was nine years old, and worked for three years as a grounds keeper for O.J. and Nicole in the early ’80s, said that Lou Brown took the photos.

Item 3: Denise claimed that her mother was listening in on the other phone line when Tom Lange called to tell Lou Brown that his daughter had been murdered. She claimed that her mother was the one who shouted, “O.J. did it!” Tom Lange said it was Denise. Juditha Brown did not believe that O.J. abused Nicole until months after the murder.

Item 4: Then there’s that business with Nicole’s missing keys. Denise said in her civil trial deposition that Nicole told her O.J. stole them. Faye Resnick said the same thing. However, Cora Fischman said in her civil trial deposition that Nicole first suspected O.J. then decided in her next breath that Faye must have stolen them. Denise was not close to Cora and if she didn’t get her story from Nicole, where did it come from? –Jasper
