In this case, phone records and individual estimates and recollections (based on who-know-what) are used interchangeably. Some phone records were not disclosed and someone at some time has disputed all but one of the records (Allan Park’s) that were disclosed. You can find a witness who guessed a time that fits any scenario you want to present or to dispute any scenario you want to dispute. That’s why I depend so heavily on Donald Freed’s “clock” approach together with my 3-D/4-D modeling approach.
You have to have reliable anchors in time and space to eliminate the impossible, to isolate the probable and to identify the ineluctable. clocks sit nearby all of the times I use as facts. Schwab and Heidstra had “clockwork” dog-walking habits. Both knew they got a late start and they knew how late because both of them looked at a clock before they left home. Schwab looked at his watch along the way and Heidstra saw the beginning of the 11:00 news when he got home. Pilnak kept her phone bill of her talk with her mother. Mandel checked the time on his receipt with his credit card company, etc….
All records of O.J.’s calls on the night of the 12th were retrieved. That’s why I picked O.J. for my example – so I wouldn’t get into a dispute about the validity of the time. Nicole told O.J. that the kids were in bed. She could have been lying (I think she WAS lying). Sorry but I didn’t think that was important. The point I tried to make was simply that it made more sense for Nicole to go directly across the street to Ben & Jerry’s after the meal than to go home and take the kids back to the ice cream parlor later.
I don’t see a conflict in Rachel’s father’s estimate of the time the talked to Nicole unless he said he looked at his watch. An estimate is a guess. It’s not a measurement. If he was off by only five or six minutes it’s still a good estimate
By the way, I got the 9:25 time from Freed’s Killing time. For the point I wanted to make, that was close enough whether or not he got it down to the minute. –Jasper
