The only reason there is any confusion about the Mezzaluna time clock is because the defense worked so hard and so well to created that confusion. Remember it was not the job of the defense to find the truth. Its job was to create reasonable doubt in the prosecution’s story. While the prosecution was trying to show that Ron left the restaurant in plenty of time to arrive at the murder scene at 10:15, the defense was trying to push the Mezzaluna time clock ahead as much as possible to make the prosecution’s killing time less likely.
Here it is in a nutshell….
The defense learned that the NCR machine used to record credit card purchases was off by an hour and 23 minutes or some oddball thing like that. The difference in time didn’t correspond to anything so they were never able to tell when Nicole paid for her last meal. In the preliminary hearing, Tia Gavin, the server who waited on the Brown party, thought that the time clock’s the employees used to punch in and out was also off because it hadn’t been adjusted for daylight savings time…She was wrong.
The time clock had been adjusted. John De Bellow’s job was to see to it that the clock was reasonably accurate (he checked it against his wristwatch). In the criminal trial Tia Gavin said that she was mistaken about the time clock and identified the time on her card that she punched out. She punched out at 10:58. Ron punched out at 9:33 but sat around taking and having a meal until 9:50 or so. He could have left later than 9:50 but not much later because when Gavin left Ron was already gone. –Jasper
