You may be right without a doubt. Look at this from the point of view of a man who truly cared and probably still loved his exwife. He had not had a real night's sleep for many days. Arrives in LA Friday night or Sat morning seriously jet lagged, then he comes home, goes to dinner for Mrs. Rabin wife of Israeli Prime Minister at the time and Mrs. Sadat with Paula Barbieri. Sunday wakes up early, jet lag showing as he is grouchy as he plays golf in early morning. Plays cards with friends as well some point in this period of time, little sleep as he knows Chicago Monday Morning don't want to get used to CA time. Sunday night goes to recital, goes home, talks a lot on the telephone, flies to Chicago, after about four hours sleep<Maybe> comes home to CA because Nicole is murdered, taken to police station. Probably no sleep for days. Any decision he made within that time was expedient. Not rational or thinking about the future or consequences, just taking care of what he has to take care of. Next thing he knows he's in jail. Brown's changes their story just before trial, too late to do much about custody.
