Right you are. The prosecution needed Bushey to clean up a mess and he did have the information from prior testimony to say what he did about the joint custody arrangement. But he created another mess that the prosecution apparently didn’t anticipate when he gave the time of his talk with Phillips and the fact that it was Phillips who called him. If the call came at 2:30 O.J. probably wasn’t a suspect – to Bushey.
When you think about it, it was fortunate for the prosecution that the McKinny tapes surfaced when they did. Otherwise this whole discussion we’re having now about who identified Nicole’s body and when it happened would come center stage in O.J.’s criminal trial. That would have brought the fireman and Jeff center stage.
Charlie has a good point about the fireman and Jeff. If they were there when Fuhrman was there, they could have been important witnesses with respect to the testimony of Riske, Phillips and Fuhrman about when the pointing finger photo was taken. If they weren’t there at that time Bushey’s testimony opens the door to perjury charges against Phillips and Fuhrman with respect to the time he ordered Phillips to make the death notification.
That would not have been a “collateral” issue in that it blows apart notion that Phillips, Roberts and Fuhrman had nothing to do between 2:30 and 4:05. It shows that they lied about that, too, and it strongly suggest that the prosecution knew it. –Jasper
